INTRODUCTION

At Shell Vacations LLC, the privacy and confidentiality of user information is important. We are committed to maintaining the privacy and security of your user information. We may update this policy from time to time, so please check here frequently.

  • Shell Vacations LLC and its affiliates, subsidiaries and parent companies (collectively as further defined below," Company", "we" or "us") respects your privacy and considers it to be very important. Company is committed to providing you with the finest rental, vacation ownership and vacation club membership products, backed consistently by first class service. To further allow us to offer you products and services that may interest you and best meet your needs, whether they are available directly from Company or through relationships with other companies, Company may share information about you internally, with its affiliated companies and with non-affiliated companies. The purpose of this privacy policy ("Privacy Policy") is to clearly and concisely inform users of and visitors ("you" or "your") to the Sites (defined below) of, without limitation: (1) the information that we collect through the Sites; (2) how we use and protect that information; (3) what information we may share with third parties and generally those third parties with whom we may share information (including what information may be shared publicly); and (4) how you can "opt-out" of having personally identifiable information (PII) collected about you. and, (5) how you can review and request modification of your PII collected by the Sites.
  • This Privacy Policy applies to any and all Company owned or operated websites, including, without limitation, shellvacationsclub.com, shellhospitality.com, svctours.com, nimotravel.com, svcdiscovery.com, any other web sites for individual Shell Vacations Club resorts accessed through, without limitation, shellvacationsclub.com, shellhospitality.com, svctours.com, nimotravel.com, or svcdiscovery.com (collectively, the "Sites") (however accessed and/or used, whether via personal computers, mobile devices or otherwise). This Privacy Policy only covers the Sites and does not cover any information collected in the "real world" [offline] or at any other web site whether or not owned by us.
  • This Privacy Policy also applies to interactive features and/or downloads that we own and/or operate and that are available through the Sites. This Privacy Policy also applies to interactive features or materials that interact with the Sites and post this Privacy Policy.
  • This Privacy Policy is subject to the Terms of Use of the Sites.

Information We Collect

Company collects certain potentially non-public personally identifiable information ("PII") to deliver the high quality service you can expect from us. Below is more specific details about the information we collect and your options with respect to that information.

  • Information You Provide Directly to Us:You may provide us with certain categories of personal information such as, without limitation: your first name, general geographic information, etc. This may be through credit applications, membership agreements, making reservations, utilizing resort services, loan servicing, or Member benefits (certain users may be registered members ["Members"], or generally through your relationship with Company). Additionally, we may collect statistical information, such as gender, zip code, etc., including, without limitation through account registration and application or other forms, e-mail, newsletter sign-ups, information you may provide to us by direct communication such as e-mail, telephone, facsimile and/or through interaction with and use of the Sites. We may also collect PII you provide to us such as name, physical address, e-mail address, birth date, and, if involved in a financial transaction or reservation and/or seeking credit, your social security number, income and employment information, account balances and transaction history, credit history and payment history and credit card number. We only collect financial information/credit related PII if you specifically request a financial transaction, reservation, or credit application and only from you and/or with your specific consent. We treat personal information in combination with statistical information as PII for purposes of this Privacy Policy. Certain financial transactions are subject to additional disclosures under Federal law. In such cases, you will be provided with such additional disclosures as required by law. Because some of the information we may collect is financial information, it is particularly important that you read this notice carefully to understand what we do.
  • Information We May Collect During Your Visit(s) to the Sites: In addition to information that you may specifically provide to us, while you visit or interact with the Sites, we and/or our third-party service providers may collect certain information about you/your visit(s) to the Sites. This information may be collected through automated or passive means and may include a variety of technologies that automatically or passively collect certain information whenever you visit or interact with the Sites such as your browser, the URL from which you linked to our Sites, usage information about pages and/or features within our Sites that you visit, and statistical data such as date and times of your visit(s) and activities while visiting our Sites, and other similar information. We may also collect your IP address or other automatically assigned identifiers that allow us to identify the device and/or mechanism through which you are accessing the Sites. If either or both are combined with any of the personal information listed above, we treat device/mechanism identifiers and your usage information as PII for purposes of this Privacy Policy. We may use this information in order to remember you and your preferences and to track your visits to our Sites and the pages available through our Sites.

Secure Reservations.

If you decide to make an online reservation at the http://www.shellhospitality.com/, you will be linked to a reservation interface and a third party booking engine (“Booking Engine”) provided by Sabre Hospitality Services. While it appears to be part of our site, the Booking Engine is in fact provided by a third party and is governed by its privacy practices. We understand that security remains the primary concern of online consumers and have chosen the Booking Engine Vendor carefully.

  • How We Collect Such Information: In addition to information that you may specifically provide to us, during your visit(s) to the sites, we may collect information using such technologies as: cookies, Flash cookies, web beacons, embedded script and similar technologies. "Cookies" are data files placed on a device used to access the Sites. A Flash cookie is a data file placed on a device via a third-party plug-in (which may be built into your device or downloaded to your device). Small graphic images or other web programming code which may be invisible to you called web beacons may be included in our web pages and e-mail messages. Web beacons or similar technologies may be used to count visitors to the Sites, to monitor how users navigate the Sites, to count how many e-mails that were sent were actually opened or to count how many particular articles or links were actually viewed, and/or for similar purposes. An embedded script is programming code that is designed to collect information about your interactions with the Sites, such as the links you click on. The code is temporarily downloaded onto your Device from our web server or a third party service provider, is active only while you are connected to the Sites, and is deactivated or deleted thereafter.
    • We may, from time to time, supplement the information we collect about you online with outside records from third parties in order to enhance our ability to serve you, to tailor our content to you and to offer you opportunities to purchase products or services that we believe may be of interest to you. We may combine the information we receive from those sources with information we collect through the Sites. In those cases, we will apply this Privacy Policy to any PII, unless we have disclosed otherwise.
    • If you send someone else a communication from the Sites, such as sending an article to a friend or information about a job opening, we use the information you provide (typically, names and e-mail addresses) on a one-time basis to facilitate the communication and we do not use it for any other marketing purpose, unless we obtain consent from that person.

How We May Use The Information Collected

  • We may use the information that we collect about you: (1) to provide you with the widest range of products and services, to provide information or services or to process transactions as you have requested or agreed to receive, including to send you electronic newsletters, or to provide you with special offers or promotional materials on behalf of us or third parties; (2) to enable you to participate in a variety of the Sites’ features such as online entry sweepstakes and message boards; (3) to process your registration with the Sites, including verifying your e-mail address is active and valid; (4) to improve the Sites or our services, to customize your experience on the Sites, or to serve you specific content that is most relevant to you; (5) to contact you with regard to your use of the Sites and, in our discretion, changes to the Sites and/or Sites’ policies; (6) to comply with court orders, valid subpoenas, and/or other applicable laws and regulations; (7) for our business purposes; (8) for purposes disclosed at the time you provide your information or as otherwise set forth in this Privacy Policy (such as, if you request and/or enter into certain financial transactions (9) to share with third parties as reasonably necessary to evaluate creditworthiness, register transactions, make reservations (including, without limitation, reservations with external exchange or through the SVCLifeStyles™ or SVCElite® , SVCCollections™ programs (hereinafter “Benefits Providers”)), service loan accounts, and to improve the Sites. If you provide comments or commentary or other materials to the Site(s), we may use the comments and materials as provided (or in a reasonably similar manner) which may include your full name and other information as further set forth in the Terms of Use.

Information We May Share

    • Information We May Share with Third Parties: We may share non-PII, such as aggregated user statistics, with third parties or for the purposes listed immediately above and for such purposes as providing statistical aggregate (non-PII) data to advertisers and for Company and Company affiliates to offer additional products that may interest you or best serve your needs. The decision to purchase such products or services is yours alone. We do not share your PII with third parties for those third parties’ marketing purposes unless you consent to such sharing at the time you provide such information. We may share the information we have collected about you, including PII, as disclosed at the time you provide your information and as described in this Privacy Policy. We do not share your personally identifiable information for any other purposes and are not shared with unaffiliated outside parties. We endeavor at all times to only share PII on a "need to know" basis and for legitimate business purposes as disclosed here.

If you agree (or do not decline) to receive information and/or marketing materials from third parties, your PII may be disclosed to such third parties and all information disclosed (by you or by us) will be subject to the privacy policy and practices of such third parties. We are not responsible for the privacy policies and practices of such third parties and, therefore, you should review the privacy policies and practices of such third parties prior to agreeing to receive such information from third parties. If you later decide that you no longer want to receive communication from a third party, you will need to contact that third party directly.

We may use third party vendors to perform certain services on behalf of the Sites, such as hosting the Sites, designing and/or operating the Sites’ features, tracking Site analytics, enabling you to purchase goods and/or services and enabling us to send you e-mail newsletters or performing other administrative services. We may provide these companies with access to your information, including PII, to carry out the services they are performing for you or for us.

Certain areas of the Sites may be provided to you in association with third parties and may require you to disclose personal information in order to register for and access products and/or services. Such co-branded areas will identify the third party associates. If you elect to register for products and/or services at co-branded areas you may be providing your information to both us and the third party associates. Further, if you sign-in to a co-branded area with a username and password obtained on the Sites, your PII may be disclosed to the identified third party associates for that co-branded area and will be subject to the third party associates' privacy policies.

      • Legal or Administrative Purposes: We may transfer and disclose your information, including PII, to third parties: (i) in the event we are required to respond to subpoenas or other legal process or if in our good faith opinion such disclosure is required by law; (ii) at the request of governmental authorities conducting an investigation; (iii) to protect and/or defend the Sites’ Terms of Use or other policies applicable to the Sites; or (iv) to protect the personal safety, rights, property or security of any individual. We may also use IP address or other information collected to identify users, and may do so in cooperation with copyright owners, internet service providers, wireless service providers or law enforcement agencies in our discretion. Such disclosures may be carried out without notice to you. We may also disclose non-public information about you to nonaffiliated third parties as permitted or required by law, including but not limited to, in accordance with the Fair Credit Reporting Act, providing personal information to consumer reporting agencies in the course of determining financial status.
      • Business Transfer: We may share PII with our subsidiaries and affiliates for internal reasons. We also reserve the right to disclose and transfer all information related to the Sites, including, without limitation, your PII, demographic and usage information: (i) to a subsequent owner, co-owner or operator of the Sites or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our stock and/or assets or other corporate change, including, without limitation, during the course of any due diligence process.
      • Sweepstakes, Contests and Promotions: (collectively, "Promotions"). We may offer Promotions through the Sites that may require registration. By participating in a Promotion, you are agreeing to the terms, conditions or official rules that govern that Promotion, which may contain specific requirements of you, including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice and/or likeness in advertising or marketing associated with the Promotion. If you choose to enter a Promotion, PII may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotion’s official rules, such as on a winners list.
      • Other Business Purposes: We may disclose certain PII about you to the following types of third-parties for Company business purposes, related offers, or activities: (1) Financial service providers, such as mortgage bankers, securities broker-dealers, insurance agents and companies and credit card companies; (2) Franchisees and their affiliated and subsidiary companies; (3) Non-financial companies, such as retailers, direct marketers with whom we have joint marketing agreements, manufacturers, service companies, communications companies, travel agencies, airlines, cruise lines, rental car companies, hotels and publishers; (3) Others such as non-profit organizations. We may also disclose information we collect as described above to companies that perform marketing services on our behalf or to other financial institutions with whom we have marketing or similar arrangements; and (4) Benefits Providers and third party management companies that manage resorts containing Shell Vacations Club inventory.

Information You Share Publicly

      • User Generated Content: The Sites may allow you to submit materials that you own or legally control such as photos, videos, comments, ideas, suggestions or other content in which you may include personal information (collectively, UGC) which may be published on or off line in any media now known or hereafter discovered. Others may have access to the UGC, including the ability to share it with third parties. For purposes of this Privacy Policy, UGC includes information that you may share through social media through or related to the Sites (for example, personal information or content that you may use in a social networking profile or on a social media page). We encourage you to think carefully about what UCG and about what you share through social media sites, particularly your personal information. We do not control who will have access to that information which you choose to make public and cannot control how they may use it. This Privacy Policy does not apply to information you share publicly, share with third parties or post publicly through the Sites. We are not responsible for information that you share publicly, through the Sites or otherwise.

We may use and publish your name, voice or likeness, or other personal information or PII that is part (or the whole) of your UGC. We may use the UGC (including your name, voice and/or likeness) for marketing, promotional activities, publicity and advertising.

Third Party Content and Links

The Sites may contain content provided by third parties. Those third parties may collect information about your web site usage, including about your device or computer (such as, for example, an Internet Protocol ("IP") address) when pages from the Sites are served to your web browser. Further, when you click on a third party link from the Sites (including, without limitation, "banner ads"), that link will take you to a site(s) controlled and operated by third parties whom we do not control. Once you click to a third party link, you will be subject to that third party's terms and privacy policy. We suggest you check the privacy policy of third party sites before you share any personal information with those sites.

Third Party Advertisements and/or Analytics:

The sites may serve third-party advertisements on the Site and may use third party analytics service providers to provide us with statistical information about your use of the Sites. These third parties display "ad banners" based on an analytics of the statistical data regarding your visits to the sites and other sites in order tailor advertisements for that may interest you. These third parties typically install cookies or other technology tracking technologies to track certain behavioral statistics to serve targeted ads. This Privacy Policy does not cover the methodologies used by third parties. If you check on a banner ad that re-directs you from the site, we encourage you to read the privacy policy of that site before sharing any personal information or using their services. We are not responsible for the content or practices of any third party advertiser.

Security

        We employ industry standards and technologies, including without limitation SSL and HTTPS encryption technologies, in an effort to protect your PII and other personal information you may share, However, since no transmissions over the internet or through other content/information sharing devices (such as a smart phone or a tablet) can be absolutely secured. WE DO NOT WARRANT OR REPRESENT THAT WE CAN GUARANTY THE SECURITY OF ANY INFORMATION THAT YOU TRANSMIT TO US AND YOU USE THE SITES AND PROVIDE SUCH INFORMATION SOLELY AT YOUR OWN RISK. In the event of a data or security breach in which your PII may be compromised, we make commercial reasonable efforts to notify you and/or the requisite governmental or other regulatory agency promptly and as required by law.

Children Under the Age of 13:

        The sites are intended for a general audience over the age of 18 (or the age of majority in the jurisdiction in which you reside, whichever is higher). We do not knowingly collect information from children under the age of 13 and we will delete any PII collected that we determine to be of a child less than 13 years of age.

Your Ability to Review your PII and Request Changes

Changes to Your PII and to Your Preferences:

You are solely responsible for the accuracy and content of any personal information which you submit to the Sites (or which may be collected by the Sites pursuant to this Privacy Policy. You have the right to view the personally identifiable information we maintain about you. Within thirty days of receiving such a request, we will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding calendar year, along with the names and addresses of these third parties. If you so request, we will also provide you with a copy of the personal information we maintain on file about you and you may reply to the same address if you wish to make changes to your PII. In order to make changes to your PII, you must provide proof of residence (so that we can confirm that you are who you claim to be). Proof of residence may include either a utility bill in your name or, in the case of a P.O. box, a rental agreement for the box showing that the box is being rented by you. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to the addresses specified in this paragraph. If you wish to change what communications you receive from us and/or how you receive such information, you may cancel or modify your communication preferences by following the instructions in a specific e-mail or communication you receive as well as by sending the Privacy Policy Preferences Change Form discussed immediately above.

If You are Outside of the United States

        The Sites are located in the United States. If you are located outside the United States, please be aware that the information we collect will be transferred, stored and processed in the United States. As data protection and privacy laws vary in different countries and you should be aware of your own country's laws regarding Privacy may differ from the United States. You consent to have your information processed, stored and transferred to the United States. You understand that your PII may be transferred to our affiliates outside the United States and will be subject to the country's privacy laws in which they are located. You expressly consent to such transfer and storage of information by your use of the Sites.

Changes to this Privacy Policy

We reserve the right to change this Privacy Policy as we deem reasonable and appropriate without notice to you. Any changes to the Privacy Policy will apply as soon as they are posted; however, we will not use your PII in a manner that is materially different from what was stated in the Privacy Policy at the time you shared the information. The "last revised" date at the beginning of this Privacy Policy reflects the date of the most recent changes to the policy. We encourage you to check the "last revised" date whenever you visit the Sites (or as often as you feel appropriate) to see whether or not changes have been made to this Privacy Policy. We may also from time to time in our discretion post notices on the Sites if there have been what we deem to be material changes to this Privacy Policy.
